Even in the midst of a pandemic, regulatory requirements are moving forward. The Canadian vape industry will be required to adhere to the most recent changes to labelling standards (Vaping Products Labelling and Packaging Regulations), effective July 1, 2020. That will present a challenge for some retailers, as they rush to move existing stock out the door and replace it with stock that meets the new standard. More challenging still because the labelling requirements may not be entirely clear to everyone in the industry and misinformation abounds in uncertain times.
It’s difficult to say whether inspectors will be forgiving of minor infractions during this transition, given that it comes at a most inopportune time, but it is probably safest to err on the side of “no.” The electronic nicotine industry has not been treated particularly fairly up to this point and there is no reason to expect that will change. There is a very real possibility that fines will be issued immediately following the implementation date. Many shops will not be able to shoulder these fines in addition to the financial hits that so many took during rolling nation-wide lockdowns and the clearance of stock that will soon be noncompliant.
It is important for consumers to know that the change to package labelling requirements is just that: a change to labels. The high quality products that you have come to enjoy and rely on from the Canadian market will remain the same, only the labels will change.
Vendors should do everything that they can to understand the new labelling requirements and ensure that the stock they are purchasing and selling meets the new standard. They should seek reassurance from their wholesalers that the stock they are bringing in is in line with the new regulations.
